Opening

This policy explains cancellation and refund rights for FM Structural's professional structural engineering consultancy services.

14-day cancellation right

If you are a consumer, you may have a 14-day right to cancel a distance contract under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

For services, you may ask us to begin work during the 14-day cancellation period. If you do so, and the services are fully performed within that period, you may lose the right to cancel once the services have been fully performed and the project deliverables have been issued.

Required checkout acknowledgement

For online buy-now instructions, before payment you will be asked to confirm:

“I expressly request that FM Structural begins providing the professional structural engineering services during my 14-day cancellation period. I acknowledge that once the services have been fully performed and the project deliverables have been issued, I will lose my statutory right to cancel.”

Cancellation before work starts

If you cancel before we have started work, we will refund the fee paid.

Cancellation after work starts but before completion

If you cancel after we have started work but before the services are fully performed and deliverables are issued, we may deduct a proportionate amount for the work already carried out.

After services fully performed

Once the services have been fully performed and the project deliverables have been issued, no cancellation refund will be due except where required by law.

If FM Structural cannot safely proceed

If we decide that we cannot safely or appropriately undertake the design based on the information supplied, we may cancel the order and issue a full refund.

Errors caused by FM Structural

If there is an error in our deliverables caused by our failure to exercise reasonable care and skill, our usual first response will be to correct or reissue the affected deliverable within a reasonable time and without additional charge.

Nothing in this policy excludes or restricts your statutory rights, including any rights to repeat performance or price reduction under the Consumer Rights Act 2015.

Client-side errors

If a revision is required because the client supplied incorrect or incomplete information, changed the brief, changed the layout, changed the construction proposal, or discovered site conditions that were not disclosed before design work began, the revision may be treated as a new instruction and charged separately.

Building Control queries

Reasonable Building Control queries relating to our issued deliverables will be answered free of charge for 90 days from issue, unless otherwise agreed.

This does not include redesign caused by changed information, changed layouts, contractor changes, undisclosed site conditions or additional scope.
